            We invite you to read carefully the present general conditions of sale. Measures below constitute a contract establishing the remote terms of sale of the present works on the www.galeriesaintcyr.com site.

Any order sent to the Gallery Saint-Cyr whatever means it is imply the unconditional acceptance and irrevocable of the present general conditions of sale. It is up to every customer, professional or private individual, to acquaint with general conditions of sales of the Gallery before placing order.
            The orders made by customers living on the metropolitan French territory, Corsica and the overseas territory, as in case of international sales, the French legislation will apply. In case of international sales, for all the questions not settled by the French law and the present general conditions of sale, the parts agree to refer to our general conditions of sale.
            The responsibility of the Gallery Saint-Cyr would not be liable in case of disregard of the regulations of a foreign country where the product is delivered.

ARTICLE 1: introduction

The web site " www.galeriesaintcyr.com ", as well as the name of domain "www.galeriesaintcyr.com" are the full property of the gallery Saint Cyr, the auto- entrepreneurship, registered in the RCS of Rouen under the number 510 327 448 and the head office of which is situated 20 rue percière, 76000 Rouen France

This company has for object the sale of oeuvres of art.


James Saint Cyr, owner of the name of domain www.galeriesaintcyr.com and responsible for the site is contactable, at the working hours (2 p.m - 7:30 p.m from Tuesday till Friday ; on Saturdays from 10 am till 7:30 pm), in 06 79 45 18 68 or in 02 35 07 43 26 either by e-mail: g.saintcyr@gmail.com

ARTICLE 2: Acceptance on the general conditions of sale and taking of order

 Any order (by clicking on " to Send my booking " on the recapitulative page of your order) is worth full and whole acceptance of the present general conditions of sale, which prevail over quite other conditions, with the exception of those who were expressly accepted by the Gallery Saint-Cyr.

To order on this site, the Customer owes inevitably:

· have 18 years old minimum.

· have the legal capacity to contract a commitment.


Any order form which you validate constitutes an irrevocable acceptance which can be questioned only in the cases restrictively foreseen on the present general conditions in the article "Low of retractation".

The systems of automatic recordings of the site are considered as being worth proof of the sale contract and of its date.


We remind that the purchase on www.galeriesaintcyr.com is only opened to the persons having the legal capacity to contract by virtue of the applicable law and that the minors are not authorized to have access to our services.

The Gallery Saint-Cyr reserves the right to modify at any time all or any of the present general conditions of sale.

ARTICLE 3: confirmation of the order by e-mail

Any order will be the object of an Email of confirmation before the delivery recapitulating the essential characteristics of products, the mode of delivery, the price excluding tax and including taxes, the expenses of delivery for the foreigner if need be, the owed taxes (for customs) and the existence of the law of retraction. 

In case the e-mail address would be erroneous and in case there is no means to contact the Customer (telephone or the other one), the delivery would be suspended until the total payment of the order.

The work will be sent as soon as the Customer will have resumed contact with the Gallery Saint-Cyr.


ARTICLE 4: contractual Documents

The contract is formed by the following contractual documents in order of priority lessening:

· The present general conditions
The order form constituted by the estimate accepted by the Customer and completed by the information necessary for the identification of the Customer (name - first name - mailing address of invoicing and delivery address, e-mail address, phone number)

· The information on the exhibited works 

The site presents the essential characteristics of the works: Title of the work, the reference, the type or the genre of the work, the dimensions, the techniques, the price, the number of copies.

Photos illustrating products are indicative and cannot enter formally the contractual field.

ARTICLE 5: rates, taxes, postal charges and customs duties

Rates indicated on the works correspond to the selling price determined by the Gallery Saint-Cyr.

The firm price is expressed in Euro, the payment of the order is payable exclusively in euro and directly with the Gallery Saint-Cyr.

The price of the work indicated is included taxes, for Metropolitan France.The expenses of packaging and port for Metropolitan France representing between 10 % and 15 % of the price of the work are included in the total price of the work.


For a delivery abroad, the Customer has to inform the Gallery Saint Cyr about it and beforehand has to fulfill with this one of the totality of the transport costs, the taxes and the costs incurred in this sending.

The possible customs charges, of port and due diverse taxes in the imports are in the complete payble by the Customer (these expenses do not concern the countries of the European Union).

The Customer makes a commitment to verify the possibilities of import of products in the country of delivery. The present works on the site are in accordance with the French laws.

The Gallery Saint-Cyr cannot be considered responsible for a violation of the legislation appropriate for the country of delivery of the work.

N.B.:As regards the very fragile objects (of type clay), postal charges indicated in your basket are indicative. Real expenses will be communicated to you by email. 

ARTICLE 6: execution of the order

The delivery can intervene only once the order validated by the Customer, the payment entirely made with the Gallery Saint-Cyr and the delay of last 7 (seven) days.

The works are packed by the Gallery Saint-Cyr with the biggest care, rolled, or with their frame and / or framed.

In case of unavailability of the ordered product, whatever is the reason (deterioration during the transport, the reserved work) you will be informed about it in most.

 You will have from then on the choice to ask or the repayment of the sums if you have already settled your order, or the possibility of choosing another work of the same Artist or the other one. 

The Gallery Saint-Cyr reserves the right to refuse any order of a Customer with whom a dispute would exist.

 By validating the order, the Customer takes the irrevocable commitment to accept the delivery of the ordered works.

A delay about 7 working days is to be foreseen.

At any time, you have the possibility of questioning us about the state of your order. However neither the carrier chosen by the Gallery Saint-Cyr, nor the Gallery Saint- Cyr would not know how to be held people in charge if one or several elements independent from their will hindered the procedure of delivery.

ARTICLE 7: payment conditions

You can pay by check, drawn up in the name of the Gallery Saint-Cyr, in the back of which, you will have noted your N of ID card ( CNI), passport ( PA) or driving licence (PC), the date of delivery and the prefecture which delivered it to you. The address of sending of the check will be communicated with you during the confirmation of the order by the Gallery Saint-Cyr.

You can also pay by postal order, bank transfer or in cash, according to the left directives the Gallery Saint-Cyr.

You can also pay by the secured on-line system Paypal. If you wish to pay by check or postal order: one or several works will be delivered only after reception and collection of the check or the mandate and spent the cooling-off period of 7 days. 

 A name specific invoice will be sent to you by the Gallery Saint-Cyr.


ARTICLE 8: transport and delivery of the work

Your work is covered by an insurance "Damages" during the transport: your acquisition will entirely be paid off to you in the case of a damage arisen during the delivery, the being valid acknowledgement of receipt. Any complaint in case of damages must be formally notified to the Gallery Saint-Cyr, by email (photo in the support) or by telephone, that very day of the reception of the parcel. Should the opposite occur, the Gallery Saint-Cyr will be held person in charge and can be the object of no pursuit, and no demand of repayment.  
Packing expenses, postal charges representing between 10 % and 15 % of the price of the work are included in the total price of the work.

For a delivery abroad, the Customer has to inform the Gallery about it Saint-Cyr and beforehand has to fulfill with this one of the totality of the transport costs, the taxes and the costs incurred in this sending.

A delay about 7 (seven) working days is to be foreseen for a delivery in Metropolitan France and 15 (fifteen) working days for the foreigner.

The expenses of deliveries contain the price of an insurance on the value of the properties. It is up to you to verify in reception, the state of the parcel and to indicate on the receipt the mention " under reserve " to benefit from guarantees contracted in case of deterioration of the works.

ARTICLE 9: clause of property reserve

The ordered works remain the property of the Gallery Saint-Cyr up to the complete payment of the work by the Customer (total price of the work, the due taxes, the packaging, the transport).

The Gallery Saint-Cyr sells its work but keeps the exclusivity.

ARTICLE 10: protection of intellectual property rights

Your rights on the bought works are limited to a law of private usage.

ARTICLE 11: protection of the particulars

The particulars concerning the Customer are treated with the biggest confidentiality.

In application of the IT law and Freedom N 78-17 of January 6th, 1978, the Customer has a right of access and rectification of the data concerning it.

The Customer can exercise this law by sending an E-mail this way to the following address: g.saintcyr@gmail.com

We never communicate the data which you supplied us in a third part or a commercial company. However we reserve us the law to send you at the address that you communicated us invitations or information concerning the activity of our site or the Artists whom we represent.

ARTICLE 12: right of retraction

You have a delay of 7 working days, as from your date of purchase to cancel your order (date appearing on the Email of validation of your order).

To exercise this law, the Customer has to necessarily, for the delay indicated in this article, inform The Gallery Saint Cyr about it,  by e-mail or telephone and by mails recommended with acknowledgement of receipt, sent to The Gallery Saint-Cyr, at the following address: Galerie Saint-Cyr, 20 rue Percière, 76000 Rouen France.

ARTICLE 13: responsibilities

The Gallery Saint-Cyr would not know how to be considered responsible for any non-fulfillment or delay which would have origin a case of absolute necessity, escaping their control, of which burden, rages, etc.

Also The Gallery Saint-Cyr cannot be considered responsible for the usage of the ordered works, the Customer being only responsible for their use by itself or by a third party.


ARTICLE 14: disputes

If, for a some reason, one of the general conditions of sale must be declared not applicable, this inapplicabilité would not affect the validity of the other measures of the general conditions, that considered not applicable being then replaced by the closest possible arrangement.

The present contract is subjected to the French law.

The disputes will be the competence of the courts situated in the competence of the Commercial court of Rouen. However the parties agree that the various which would come to occur following the present contract can be subjected to the mediation of the Center of Mediation and Arbitration of Rouen.
